Joseph Kabila Stripped of Immunity: Former DRC President Faces War Crimes Charges

On Thursday, the Senate of the Democratic Republic of Congo voted to lift the parliamentary immunity of former President Joseph Kabila, allowing for his prosecution on serious charges including treason, war crimes, crimes against humanity, and involvement in an insurrection. The decision was passed with 88 votes in favor, 5 against, and 3 abstentions.

Kabila, who served as president from 2001 to 2019, holds the title of senator for life, which had granted him immunity from prosecution. However, the military attorney general requested the Senate to revoke this immunity to enable legal proceedings.

Justice Minister Constant Mutamba stated that the government has gathered substantial evidence implicating Kabila in supporting the M23 rebel group, which has intensified conflict in eastern Congo. The M23, reportedly backed by Rwandan forces, has captured key cities such as Goma and Bukavu since January. Kabila is accused of backing the rebels and preparing an insurrection, allegations he denies.

In response to these developments, the Congolese government has suspended Kabila’s political party, the People’s Party for Reconstruction and Democracy (PPRD), and initiated steps to seize assets belonging to him and his associates. Kabila has been residing in South Africa since late 2023.
