B.job description

OBJECTIVES

The objectives of the position are to:

Ensure that the Company’s activities comply with all relevant legal and regulatory requirements regarding agreements with concessions, licenses, permits, and perform land acquisition and resettlement issues applicable to all Contracting States.
Ensuring consistency with requirements, strategy, and goals set by REL and lenders, such as compliance and Code of Conduct.
REPORTING LINES AND RELATIONS

Project Direct Report: Government Liaison Manager
Line Manager Managing Director
Subordinates: Permitting parties (Rwanda, DRC), Land Acquisition Teams (Rwanda, DRC)
Internal: Board of Directors, Project Steering Committee, Project Co, project team members (in particular Social & Environmental Manager)
External: Peoples and organizations impacted by the implementation of the project (Land owner, land users, etc.) owners, contractors incl. consultants
MAIN DUTIES

Ensure the project is developed to meet the legal requirements of the Contracting States, Lenders and Owners.
Conduct legal due diligence specifically to determine inconsistencies of laws between the Contracting States
Lead in preparation of Licencing and Permitting Plan including all licences and permits required by the Company and its contractors, and in securing such required by The Company.
Lead the preparation of application for concessions, permits and licences to be obtained by The Company and follow up towards authorities during their assessment and
Liaise with other disciplines to determine and ensure necessary concessions, licenses and permits are identified and in-place as needed
Ensure compliance with requirements of various concessions, licenses and permits including that of Lenders/Grants contributors.
Identify and manage legal, regulatory and land acquisition risk
Coordinate closely with Social & Environmental Manager for the development of Land Acquisition and Resettlement Action Plan (RAP)
Lead in securing land and land rights according to Project Agreement, RAP and international standards
Perform Integrity Due Diligence of contractors and individuals during contracting and hiring of project personnel.
Conduct audits of contractors to ensure they meet with Owner’s and Lenders Code of Conduct.
Prepare inputs for tender such as licenses and permits to be obtained by contractor
Perform legal review of service and construction contract to ensure compliance with applicable laws.
Represent The Company in the Joint Implementation Unit for land and land rights acquisition
Prepare updates on legal, regulatory and land as required
COMPETENCIES / REQUIREMENTS

Legal degree
At least 12+ years of the relevant experience from implementation of infrastructure projects. Experience from Hydropower is an asset.
Experience from working on projects funded by EIB, World Bank or other multinational banks.
Substantial experience in working with international environment, in particular from developing countries
Experience in work place communication, consultation and negotiating for practical result
Good communication skills and experience with managing conflict issues
Excellent writing skills (reporting)
Comprehensive knowledge of applicable, Rwandese and DR Congo legislation and int. standards/requirements (IFC performance standards)
Fluency in English. Fluency in French is an asset.
