Gisele Busima Nebale’s case is one of the tragedies revealing the abuse of power, the violation of individual freedom, and cruel and inhuman treatment that goes beyond the bounds of law.

Nebale who was in a relationship with DRC’s Minister of Communication and Media Patrick Muyaya until December 2021, is an American national with Congolese Origin.

She has taken her case to Belgian and American courts, after being held captive in the Democratic Republic of Congo by two powerful figures: Patrick Muyaya who’s also the country’s government spokesperson, and General Ndaywell, former head of military intelligence and current commander of land forces.

The accused also include a Congolese Colonel called Ralph Muzimba.

Nebale accuses them of kidnapping, arbitrary detention, failure to respect her fundamental rights and defamation.

The complainant alleges that she was arbitrarily arrested and detained without a legal warrant, a clear violation of the principles of the rule of law.

His lawyer, René St-Fort, a criminologist and lawyer, denounces acts “committed outside established legal procedures” and underlines the illegality of the decisions taken against her client.

Furthermore, Gisèle Nebale Busima claims to have been the victim of a defamation campaign aimed at publicly discrediting her.

She says that she was allegedly falsely accused of being a “Rwandan spy,” an allegation she described as “purely false and slanderous.”

“These unfounded accusations have seriously damaged my reputation and professional life,” she said.

“I was held captive in a hotel for 45 days, room 202. They exposed me by posting my address on social media,” she denounces adding “Today, I fear for my safety and that of my parents back home.”

In a press release, the Bill Clinton Foundation for Peace (BCFP) states that it has had contact with the lawyer of Mr. Patrick Muyaya, Mr. Arnaud LOKEKA.

According to Mr. Arnaud LOKEKA, Mrs. Gisèle was not arrested because of Muyaya, but rather because of her romantic relationship with Corneille Nangaa, the coordinator of Congolese River Alliance whose members include M23 movement.

Muyaya’s lawyer allegations are formally denied by Mrs. Nebale Busima’s lawyer, who states that his client was informed that the Minister had hacked her phone for personal purposes and often confronted her about her messages and movements.

He added that it is absurd for the Minister to claim that he was married to Mrs. Gisèle, with whom he has two children.

According to René St Fort, Minister Muyaya had swore to her client that he would use all possible means to have her arrested and, he kept his promise.

He added that her client’s two phones have been confiscated by the DEMIAP till now.

According to Mr. René ST FORT, Minister Muyaya continues to defame her client on the grounds that she was interned in a psychiatric hospital in the United States while presenting her as a spy.
