There was eruption of a debate during the case of Kanyabutembo Virginie, a US based Rwandan woman versus her once husband, Rugamba Xavier, over the ownership of properties located in Mbugangari Sector, Rubavu District, Northe western Rwanda.
During the case hearing, the debate has erupted due to the fact that both parties submitted challenges regarding two last verdicts.
Lawyer of the accused, Mutagoma Robert Anastase told the court that the case does not deserve to be tried by the Rwandan Court of Appeal. He cited, if there was something unclear, Kanyabutembo should have consulted Rugamba Xavier for clarification.
The statement is in regard that Kanyabutembo rectified article 140, 32 paragraph in order to be able to submit her case in Court of Appeal.
Mutagoma was suggesting, The Court of Appeal should only examine the way both parties can share properties composed of a plot of land and a house.
Kanyabutembo’s lawyer, Twizeyimana Theophile contest the statements citing, the decision by Kanyabutembo was due to the unclear verdict from Musanze High Court and Me Ntagara Alain Mucyo said “We deserve the right to appeal in accordance to the law.”
The decision on if there will be appeal on either first verdict, the second or both, will be announced on April 13, 2022.
