Kigali High Commercial Court decides owner of goods in the case involving two Indian nationals

High Commercial Court based in Kigali, Rwanda has on Monday, 28 decided that the goods worth millions, that were sold through auction, belongs to Indian national, Manish Kumar, the owner of UNITED SPIRITS Ltd company instead of his countryman, RISHI ARYA.

The goods were sold by RISHI ARYA using a bailiff, one Kagame K. Festo and were bought by businessman namely Anatole Nsengumuremyi. RISHI ARYA said the company from which Manish Kumar bought the goods, owed him a yet to know amount of money, hence, he sold the goods to get his money back.

However, UNITED SPIRITS Ltd got the buying agreement for the goods, issue that raised the concern over the ownership of the goods.

The court decided that UNITED SPIRITS Ltd owns the 3356 boxes of goods and ordered the January 31, 2022 auction is illegal, hence canceled.

The court also ordered that the auction regarding other 844 boxes of goods still valid and ordered to refund Nsengumuremyi Anatole who bought 2512 boxes of whisky via auction.

The Kigali High Commercial Court has also ordered that there will be no compensation in the appeal case, yet the one ordered during high court verdict will remain.
